Terms

Last updated

These terms cover using bionictalent.com and the commercial terms we place talent on. They are written in plain English on purpose. Where something is a target rather than a promise, it says so.

These terms

By using this site you accept these terms. If you engage us to run a search, these terms apply alongside whatever we confirm to you in writing about that engagement. Where the two disagree, the written engagement confirmation wins.

What we do, and what we are not

Bionic Talent is a recruitment firm. We source candidates, vet them, and introduce a shortlist to you. You interview, you decide, and you hire the person directly.

We are not, and do not act as:

  • your employee’s employer, or a co-employer;
  • a staffing agency that bills you monthly for their time;
  • an employer of record or professional employer organisation;
  • a payroll, tax, or benefits provider.

We take no cut of the salary you pay and add no monthly markup. That is the whole model, and it is why the fee is what it is.

Fees

$1,997 flat per hire. Every role, no exceptions, however senior the position or however long the search takes.

Due only when you hire. There is no retainer, no fee to speak with us, and no fee for receiving a shortlist. If nobody on the shortlist is right for you, you owe us nothing. The fee is invoiced when a candidate we introduced accepts your offer.

If an accepted candidate never starts, that is a failed placement, not a completed one. We re-run the search at no additional cost exactly as we would for a replacement, or credit the fee against a future placement if you would rather stop there. You will not have paid us for somebody who never worked a day.

The fee is ours if you hire a candidate we introduced to you, whether or not that hire is for the role we originally scoped, and whether or not the introduction came through the shortlist.

You pay the person you hire directly. Their salary is between you and them and is not part of our fee.

Replacements

Unlimited free replacements for 90 days. If a hire is not the right fit within 90 days of their start date, we run the search again at no additional cost, as many times as it takes inside that window. There is no cap on the number of replacements and no second fee.

The replacement is a re-run of the search. It is not a refund of the placement fee, and it does not cover the salary you have already paid the hire or any cost you have incurred employing them.

Timelines are targets, not guarantees

We aim to put a shortlist in front of you within 6–10 business days of the intake call, and across our placements the average time from that call to a hire starting is about 21 days.

Those are targets and historical averages, not contractual commitments. A narrow brief, a hard-to-source skill set, or a slow interview loop on your side all move them. We would rather quote you the real range than a better-sounding number we then miss.

What we do not guarantee

We do not guarantee that a search will produce a hire, that any candidate will accept an offer, that a hire will stay for any period, or that hiring through us will produce any particular business result. Vetting reduces risk; it does not remove it.

Roughly the top 1% of applicants reach a client, and our vetting covers English fluency, role-specific skills on the actual tools, and work-history and reference checks. It is a screen, not a warranty. You are responsible for your own interviewing and your own hiring decision.

You employ the candidate

Because you hire directly, everything that comes with being the employer or engaging party is yours:

  • classifying the relationship correctly (employee or independent contractor) under the law that applies to you and to the country the person works in;
  • paying them, and handling any withholding, tax, social contribution or benefit obligation that attaches;
  • work authorisation, immigration status, and any local registration required to engage someone in their country;
  • the terms of their contract, confidentiality, and how you handle any data you give them access to;
  • supervising, managing, and evaluating their work, including in regulated contexts where you are accountable for it.

We do not give professional advice

Nothing on this site, and nothing said by our team, is legal, tax, accounting, employment, immigration or compliance advice. That includes anything about worker classification, cross-border engagement, payroll, or what a particular arrangement means for your obligations.

We know how our clients hire because we have watched a lot of them do it. That is not the same as being qualified to advise you on it. Take your own advice from your own advisers before you engage anyone offshore. If you are a law firm, this is the clause you already knew was coming.

Images and candidate profiles on this site

Candidate profiles shown on this site, including on Talent and elsewhere, are illustrative examples of the kind of person we place, drawn from real roster and market data. They are not live listings and the specific person shown may not be available.

The portraits accompanying those profiles may be illustrative images, including AI-generated ones, rather than photographs of the individual described. We do not present them as photographs of a named person, and you should not treat a portrait on this site as an image of a specific candidate you might hire.

This does not apply to our own team. The photographs on About are genuine photographs of real Bionic Talent staff, named accurately.

Salary figures in the salary guide and on the industry pages are indicative market ranges that move over time. They are not a quote and not an offer of employment at that rate.

Client names and logos

Client names and logos shown on this site identify companies we have placed talent with. They are shown as evidence that the business is real, not as an endorsement by that client and not as a promise that you will get a similar result.

Using this site

Please do not:

  • scrape, bulk-download, or systematically copy the content of this site;
  • attempt to break, overload, or gain unauthorised access to the site or the systems behind it;
  • submit a hiring enquiry you have no intention of following through on, or someone else’s details as your own;
  • use candidate information we share with you for anything other than evaluating that person for the role you engaged us on.

The text, design, and images on this site belong to us or to the people we licensed them from. Quoting us with a link is fine. Republishing the pages is not.

Links to other services

This site links to services we do not run: our careers site at careers.bionictalent.com (opens in a new tab) for job seekers, and the scheduling and CRM tools behind the enquiry form. Their own terms and privacy notices apply when you use them. What we collect through this site is described in our privacy policy.

Liability

We provide this site and our recruitment service in good faith and with reasonable care. To the fullest extent the law allows, we are not liable for indirect or consequential loss — including lost profit, lost business, or the cost of a hire not working out — and our total liability in connection with an engagement is limited to the fees you have paid us for it.

Nothing here limits liability that cannot be limited by law, including for fraud.

Changes to these terms

We update this page when the business changes, and the date at the top moves when we do. The terms that apply to an engagement are the ones in force when it was confirmed.
